This policy explains what personal information VODSMITH LLC (“VodSmith,” “we,” “us”) collects, why, who else touches it, how long we keep it, and what you can make us do about it. VODSMITH LLC is a New Jersey limited liability company and is the controller of that information.
The short version. Today the only thing we collect is your email address, if you join the waitlist. When accounts open we will also hold your account details and the video you upload. We do not sell personal information, we do not use your video to train machine-learning models, and we delete source video on a fixed 14-day schedule.
If you enter your email address in the waitlist form, we collect that address and the fact and time of your signup. Our waitlist provider also generates a referral position for you. We use this only to tell you when the private beta opens and to run the referral queue. This is the only personal information VodSmith collects at present.
When you create an account we will collect your email address, authentication identifiers, and your plan, credit balance, and billing history. Payment card details are handled by our payment provider and never reach our servers.
The video and audio you upload, and everything derived from it: transcripts, detection data, preview files, and finished exports. This can contain personal information if your stream does, including your voice, your face if you use a facecam, and anything said on the recording.
Standard server and network logs, including IP address, browser type, and pages requested. We use Cloudflare Web Analytics, which is cookieless and does not fingerprint visitors or track them across sites. We do not use advertising cookies and we do not run third-party ad trackers.
Where the EU or UK GDPR applies, our lawful bases are performance of a contract (operating the Service), legitimate interests (security, abuse prevention, product operation), consent (waitlist and marketing email, which you can withdraw at any time), and legal obligation.
We use the following subprocessors. They act on our instructions and are not permitted to use your information for their own purposes.

We do not sell personal information and we do not share it with third parties for their own marketing. We may disclose information if legally required, or to protect our rights or the safety of others.
We do not use your video, audio, transcripts, or outputs to train any machine-learning model, and we do not permit our processors to train theirs on it. Your footage is sent to our AI provider to produce your cut, and for nothing else.
We also will not use your content or likeness in marketing unless you give explicit, opt-in permission first. That permission is off by default and can be withdrawn.

You can delete a project yourself at any time, which removes it ahead of this schedule.
Wherever you live, you can ask us to give you a copy of the personal information we hold about you, correct it if it is wrong, or delete it. You can unsubscribe from any email we send using the link in it, or by writing to us.
If you are in the EEA or the UK, you also have the right to object to or restrict certain processing, the right to data portability, the right to withdraw consent at any time, and the right to complain to your local supervisory authority.
If you are in California, you have the right to know what we collect and why, the right to delete it, the right to correct it, and the right not to be discriminated against for exercising those rights. We do not sell or share personal information as those terms are defined by the CCPA.
To exercise any of these, email hello@vodsmith.com. We will respond within the time the applicable law allows, and we may need to verify who you are first.
We are based in the United States and our providers process information there. If you are outside the United States, using the Service involves transferring your information to the United States, where privacy laws differ from those in your country.
The Service is for people aged 18 and over. We do not knowingly collect personal information from anyone under 18. If you believe a person under 18 has given us information, email us and we will delete it.
We use access controls, encryption in transit, and tenant isolation so that one customer cannot reach another customer's media. No system is perfectly secure, and we cannot guarantee absolute security.
We may update this policy. Changes are effective when posted, and we will update the effective date above. For material changes we will make reasonable efforts to notify you.
