DMCA Copyright Policy

VODSMITH LLC (“VodSmith,” “we,” “us”) respects the intellectual property rights of others and expects its users to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (17 U.S.C. § 512).

Filing a notice of infringement

If you believe content stored or processed through the Service infringes your copyright, please provide our agent a written notice that includes:

  1. your physical or electronic signature;
  2. identification of the copyrighted work you claim has been infringed;
  3. identification of the material you claim is infringing, with enough detail for us to locate it;
  4. your contact information, including address, telephone number, and email address;
  5. a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
  6. a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

Notices that do not substantially comply with these requirements may not be actionable. Please note that under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material is infringing may be liable for damages.

Counter-notification

If you believe your material was removed or disabled by mistake or misidentification, you may send our agent a counter-notification that includes:

  1. your physical or electronic signature;
  2. identification of the material and the location where it appeared before it was removed or disabled;
  3. a statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification; and
  4. your name, address, and telephone number, a statement that you consent to the jurisdiction of the U.S. District Court for the District of New Jersey, and a statement that you will accept service of process from the party who filed the notice.

Repeat infringers

It is our policy, in appropriate circumstances, to disable or terminate the accounts of users who are repeat infringers. We may also suspend or terminate accounts for the other grounds described in our Terms of Service.

How the Service handles files

VodSmith stores and processes files at the direction of the user who uploads them and returns the result to that same user. Uploaded files and generated outputs are private to the user unless that user chooses to publish them elsewhere. We do not host a public library of user content and we do not make user uploads or outputs searchable or browsable by others.
